ANC president Jacob Zuma's criminal case was provisionally set down for August 25 after a brief hearing in the Pietermaritzburg High Court on Wednesday.

He will also return to the same court on June 24 to apply for a permanent stay of prosecution.

Senior counsel for arms company Thint, Michael Collins, said the arms company would return to the court on June 24 for its own permanent stay of prosecution application *1.

Two corporate entities were implicated in the state's investigation.

The plan was to consolidate the two sets of charges into one.

After Judge Leona Theron handed down her decision Zuma left the court quietly after a quick smile at Thint boss Pierre Moynot *2, who had joined him in the dock.

Zuma was expected to address supporters in nearby Freedom Square in a party rally ahead of the upcoming elections.

*1       This will centre around the deal done by The Two Donkeys Bulelani Ngcuka and Penuell Maduna to withdraw charges against Thint in exchange for Alain Thetard affidavit confirming that he was the author of the encrypted fax.

This was one of the most assenine "deals" ever made by the NPA and would certainly have ensured that Ngcuka could not be considered as a fit and proper person for the post of NDPP.

It was unnecessary for the NPA to get some confirmation from Thetard because there was plenty of other evidence, forensic, circumstantial and witness testimony as to the authenticity of the encrypted fax as well as to its intended meaning.

It certainly was not meant as a confirmation of Zuma;s request for a donation by Thomson-CSF to the Jacob Zuma Education Trust.

But we must wait patiently.
