Dear Ms Abreu
 
I trust that you have by now received my fax of 12 February 2002. You will recall your comments regarding my so-called "repetitive and somewhat tiresome requests" in connection with what you incorrectly understood to be a reference to legal action against this office. You would also recall your response that you have not commenced with such legal action and that should this position ever change you would "follow the correct procedures".
 
We have noted that your intentions with regard to legal action appeared to have changed suddenly as Dr Young signed an affidavit in support of an application in which the Public Protector is cited as a respondent, only two days later. Our attorneys have, despite our repeated requests and your explicit undertaking in this regard, not been informed.
 
As the subject of the mentioned legal action is similar to your, to date incomplete, application for access to information submitted to this office, and as the Public Protector has not yet made a decision as to whether or not your court application would be opposed, the matter is now regarded as sub-judice and all future correspondence with this office should therefore be addressed to our legal representative, Ms C Dreyer, the State Attorney, Pretoria.
